1. About these terms
These terms apply to your use of www.orbitaltechltd.com (the "site"), which is run by Orbital Technologies LLC ("Orbital", "we", "us"), headquartered in Florida, USA. By using the site you agree to them. If you don't agree, please don't use the site.
If you use the site on behalf of a business, you confirm that you are allowed to accept these terms for it.
2. Our services and products are covered by separate agreements
These terms cover the website only. When you hire us for a service or subscribe to one of our products, that relationship is governed by the proposal, order form or agreement we both sign (your "client agreement"). If anything on the site conflicts with your client agreement, the client agreement wins.
3. Prices, plans and figures on the site
- Prices, plan contents, turnaround times and contract terms shown on the site are a guide. They are not an offer that you can accept by contacting us. They become binding only when they are written into a client agreement.
- We may change our prices and plans at any time. Changes do not affect a client agreement that is already signed.
- The cost calculator compares our prices with typical market rates. Its results are estimates for illustration, not a quote.
- Results, statistics and client outcomes described on the site reflect past work. Every business is different, and they are not a promise of the same result for you. Any guarantee we give will be set out in writing in your client agreement.
4. Products marked "coming soon"
Products and features marked "coming soon", "preview" or "early access" are still being developed. Their features, prices and launch dates may change, and we may decide not to release them. Joining a waitlist does not guarantee access or a particular price.
5. Spiffy applications
If you apply for Spiffy, you confirm that the information and documents you send are accurate and genuine, and that you are authorised to apply for the business named. We review every application and may approve or reject it at our discretion. Approval does not create a contract: your use of Spiffy is governed by your client agreement. How we handle your application and documents is explained in our Privacy Policy.
6. Using the site properly
You agree not to:
- use the site for anything unlawful, fraudulent or harmful;
- send false information or impersonate anyone through our forms;
- send spam, malware, or content that infringes someone else's rights;
- try to gain unauthorised access to the site, our admin area, our systems or other people's data, or test their security without our written permission;
- overload or disrupt the site, including by automated scraping at a volume that affects its performance.
7. Our content
The site's content, including text, design, graphics, logos, product names and screenshots, belongs to Orbital or our licensors and is protected by intellectual property laws. You may view it and share links to it. You may not copy, republish or use it commercially without our written permission. Client names and logos shown on the site belong to their respective owners.
8. What you send us
When you send us a message or an application, you let us use its contents to reply to you, assess your request and work with you, as described in our Privacy Policy. Please don't send confidential business information through our forms before we have agreed on confidentiality terms. We are happy to sign an NDA before a detailed discussion.
9. Links to other sites
The site links to other websites and services, such as WhatsApp. We don't control them and aren't responsible for their content or how they handle your data.
10. No warranty for the site
We work to keep the site accurate and available, but we provide it "as is" and "as available". To the extent the law allows, we make no warranties about the site, including that it will be error-free, uninterrupted or free of harmful components, or that its content is complete or up to date. The content is general information about our business, not professional advice.
11. Limits on our liability
To the extent the law allows, Orbital will not be liable for any indirect, incidental, special or consequential loss, or for lost profits, revenue or data, arising from your use of the site or your reliance on its content. Our total liability to you for any claim relating to the site is limited to US$100. This section does not limit liability that cannot be limited by law, and it does not apply to your client agreement, which sets out its own terms.
12. Governing law
These terms are governed by the laws of the State of Florida, USA, without regard to its conflict of law rules. Any dispute about them will be heard by the state or federal courts located in Florida, and both of us agree to their jurisdiction. If you are a consumer, this does not take away any protection you have under the mandatory laws of the country where you live.
13. Changes to these terms
We may update these terms from time to time. The new version applies from the "last updated" date at the top of this page. If you keep using the site after that date, you accept the updated terms.
14. General
If a court finds part of these terms unenforceable, the rest still applies. If we don't enforce a term straight away, we can still enforce it later.
